Terms of service

These terms cover your use of Tendally — the point-of-sale app, the browser version, your online store, and this website. By buying a licence or using the software, you agree to them.
What a licence gives you
An activation code licenses one store for the period stated on the plan you bought, normally 365 days, across the number of devices in that plan. Within that licence you get the point-of-sale software, cloud sync and backup, and an online store at a tendally.com address.
A code can only be used once, and once redeemed it is permanently tied to that store. Adding devices beyond your plan’s limit requires a plan that covers them.
Free trial
You may create one store on a 30-day free trial without buying an activation code. A trial is limited to one per account and one per phone number, and runs in the web app only — it does not activate the desktop or mobile apps, and no till can be added to a trial store.
A trial ends exactly 30 days after it starts, with no grace period. Selling then stops until you buy and enter an activation code, but nothing is deleted — your products, sales and customers are all still there. When you do buy a licence, its period starts on the day you activate it; unused trial days are not added to it.
Payment, renewal, and expiry
Licences are paid up front for the full period through Paystack. This is not a subscription and nothing is charged automatically — when a licence is close to expiring we remind you, and you renew by buying and entering a new code.
You will get renewal reminders for 30 days before expiry and a 14-day grace period afterwards. If a licence lapses, selling is blocked but your data is not deleted — renew and everything is where you left it.
Refunds
If an activation code has not been redeemed, email us within 14 days of buying it and we will refund it in full. Once a code has been redeemed and the store is running, we cannot refund it, because the licence has been used. If the software is genuinely broken for you and we cannot fix it, talk to us — we would rather sort it out than argue about it.
What you are responsible for
- Your data and your device.Your business’s records live on your devices as well as in our cloud. Keep your devices secure, keep staff PINs private, and remove access for staff who leave.
- What you sell and publish. The products, prices, descriptions, and images on your online store are yours. You must have the right to use the images you upload, and what you sell must be legal where you sell it.
- Your customers. Orders on your online store are between you and your customer. We pass the order along; we are not the seller, we do not take the payment, and we do not fulfil or deliver anything.
- Your own tax and accounting obligations. Tendally reports what you record. It is a tool, not an accountant.
How the online store works
This is worth being explicit about, because it is a common misunderstanding.
- Your online store takes order requests. It does not process card payments and no money changes hands on it.
- An order does not reserve stock. Stock only moves when you complete the sale at the till. If two customers ask for the same last item, it is up to you who gets it.
- Orders reach your till within about a minute of being placed. The WhatsApp message the customer sends is the immediate alert.
- Custom domains are available at additional cost, up to five per store. You are responsible for owning and renewing the domain itself.
What we will and won’t do
We will keep the software working, keep your data backed up, and give you a reasonable amount of support by email. We aim for high availability of the cloud services, but we do not promise a specific uptime figure — which is exactly why the till is built to keep selling when our servers, or your network, are unreachable.
We may suspend an account that is being used to break the law, to abuse the service, or to interfere with other merchants. Where we can, we will warn you first.
Limits on our liability
Tendally is provided as it is. To the extent the law allows, we are not liable for lost profits, lost sales, or indirect or consequential losses, and our total liability for any claim is limited to what you paid us for the licence period in which the claim arose.
Nothing here limits liability that cannot legally be limited.
Ending it
You can stop using Tendally whenever you like, and ask us to delete your store and its data. A licence you have already paid for is not refunded on the basis of stopping early, beyond the refund terms above.
Governing law
These terms are governed by the laws of the Federal Republic of Nigeria, and the courts of Nigeria have jurisdiction over any dispute arising from them.
Changes
We may update these terms. The date above tells you when they last changed, and we will tell you directly about any change that materially affects what you are paying for.
